Bankruptcy CLE – “Full Disclosure: Ethics in Chapter 13?”
Chapter 13 debtors have an ongoing obligation to provide complete and accurate information throughout the life of their case, but what role does debtor’s counsel play in ensuring those disclosure obligations are met? This program will explore the ethical issues involved in representing consumer debtors both pre- and post-petition, with a focus on post-petition changes in income, receipts of assets or inheritance, or right to pursue a legal claim. Panelists will discuss counsel’s duties to communicate with and advise clients, investigate potential disclosure issues, correct incomplete or inaccurate information, and navigate situations in which a client may be reluctant to disclose.
The speakers are Rachel Jones, Staff Attorney for Chris Micale, Chapter 13 Trustee; Angela Scolforo, Chapter 13 Trustee; and Heather Parsons, Giles & Lambert.
Nisha Patel, Bankruptcy Court for the District of Columbia will serve as moderator.
